Marlin bugfix1.1.x. Thermal Runaway broken?

Can some one test if thermal runaway is working in bugfix1.1.x?
Right now I do not have much connected to my controller basically only Themister and LCD with Encoder and SDCard. I set the temp to 1. It is reading the room temp at 23. I would think after a short time I should get a thermal runaway error. I do get a Heating failed when I set the temp 50 and the temp is 23 in the room.
Thermal Protection is enable and #define THERMAL_PROTECTION_PERIOD 40 and #define THERMAL_PROTECTION_HYSTERESIS 4
I have started over a couple times now configuring the board and this last time I setup only the basics to make sure I was not breaking something.
both configuration and configuration_adv from bugfix 1.1.x. But I did not touch anything in the adv file this last time.

your concept of what thermal protection is isn't correct. It wont trigger when hot end is not heating. It works out how much its trying to heat vs how hot its getting.
